Abstract

The status of land ownership in the village of Asampay (Catamarca, Argentina) is analyzed from a legal perspective, based on the current Civil Code, and also according to local traditions and customs. The main results show that a percentage of the total inherited land area is transmitted in successive fashion, whether or not clear title has been established, and that portions of land are distributed among heirs according to the framework established by prior inheritances. Each joint heir transmits whatever percentage belongs to him or her, dividing the states into ever smaller portions that are considered fair for each legatee. This process does not usually involve the legal procedures that apply to inheritances, and does not make reference to precise geographic limits because the land has not been recorded in the provincial land registry.
